Terms of Use

Bildy App S.L. (hereinafter, Bildy) is an online service for managing various aspects of a business, including the creation and digital signing of delivery notes (albaranes). The following terms outline the rights and obligations of the user and Bildy as the service provider.

Bildy assumes that any user who uses the service has read and accepted these terms of use. Furthermore, Bildy reserves the right to update and modify the Terms and Conditions without prior notice, with the updated version always available at the website www.bildy.es.

Bildy, with CIF B55458715 and registered office at Calle General Márgalo 22, escalera 1, piso 1ºB, Madrid, 28020, provides the Bildy Website and its related services according to the terms outlined below.

This agreement will be valid from the moment you check the acceptance box at the bottom of this document. New features that may be added to the Services will be subject to these Terms of Use. If the user continues using the Service after any modifications, they will be deemed to accept such changes. The latest version of the Terms of Use can be found at https://www.bildy.es/terminos-y-condiciones.

Failure to comply with any of the Terms of Use may result in account cancellation.

1. Account Conditions
  • Users must be over 16 years old to access the service.

  • You must provide your full legal name, email address, and any other information required by Bildy during the account creation process.

  • Users are responsible for providing accurate information. Bildy reserves the right to delete any account if the information appears to be false or violates any of the usage rules.

  • Users are responsible for maintaining the privacy of their account. Bildy is not responsible for any damage or loss resulting from user failure to protect their access information.

  • Both parties agree to equate the client’s handwritten signature with any other form of security identification (such as codes or passwords). However, Bildy may require written confirmation when deemed necessary.

2. Types of Contracts
  • A paid plan contract begins when the user enters their card details and makes the first payment. The limits of each plan are specified on the pricing section at bildy.com/pricing.

  • Bildy reserves the right to unilaterally modify rates at any time without providing compensation to users.

3. Payment and Access
  • A valid bank card is required to make payments. Bildy will charge users a recurring fee based on the type of plan they’ve subscribed to.

  • The Service will be charged in advance for each period, and payments are non-refundable. There will be no refunds or credits for partial months, nor will there be refunds if the user doesn’t use the Service during the billing period.

  • The user agrees that there is no need for confirmation of contract acceptance if the contract is exclusively concluded through electronic communication.

  • If the user exceeds the limits of their account (e.g., users, invoices, contacts), they will not be allowed to add more elements unless they upgrade their plan.

  • In case of non-payment or failed charges, the user will lose access to the Service, and their data will be deleted within 30 days of the breach.

4. Service and Plan Modifications
  • Bildy reserves the right to modify or suspend the Service, temporarily or permanently, at any time and for any reason.

  • Bildy reserves the right to change monthly fees with 15 days' notice. Notifications about fee changes will be posted on Bildy's website and communicated in writing.

5. Cancellation and Termination
  • Users are responsible for properly canceling their account. Accounts can be canceled at any time through the profile menu.

  • If the account is deleted (not canceled), all content will be deleted after 30 days.

  • Users can cancel their accounts at any time but will remain responsible for all charges incurred up to the point of cancellation, including a full monthly charge for the month in which the service is suspended. Future charges will not occur.

6. Copyright and Intellectual Property
  • Bildy owns all intellectual property rights for all components of the Service, including the service name, graphics, software, and interface elements.

  • Users agree not to copy, adapt, reproduce, distribute, reverse engineer, decompile, or disguise any aspect of the Service owned by Bildy.

  • Users are also prohibited from using automated processes (like bots or spiders) to collect content from the Service.

  • Bildy does not claim ownership over user-uploaded content, but by using the Service to upload content, users agree that third parties may view and share the content.

7. General Conditions
  • The user is fully responsible for accessing and using Bildy in accordance with applicable laws, whether national or international, as well as principles of good faith, morals, and public order.

  • Users agree not to resell, duplicate, reproduce, or exploit any part of the Service without Bildy's express written consent. The Service must not be used to store or send harmful or unsolicited emails (spam).

  • The Service may be used to transmit user content, and during this process, such content may be transferred unencrypted over the internet. Users may not use the Service to transmit viruses, worms, or other malicious content.

  • Bildy does not guarantee the user's ability to use the Service, satisfaction with the Service, its continuous availability, error-free operation, or the accuracy of calculations made by the Service.

8. Security and Privacy
  • Bildy App S.L. is registered with the Spanish Data Protection Agency and complies with data confidentiality and security regulations.

  • User data is hosted on servers of a reputable company in the European Union, ensuring compliance with data hosting regulations and high security standards.

  • Bildy staff has signed confidentiality agreements in compliance with privacy regulations, including GDPR.

Return Policy
  • Monthly subscriptions: If a user is not satisfied with the Service within the first 30 days, they should contact support@bildy.es. Bildy will attempt to resolve the issue and, if not possible, provide a full refund.

  • Annual subscriptions: The same policy applies to annual subscriptions, with a full refund offered within the first 30 days.

  • Subscription renewals: Subscriptions renew automatically until manually canceled. A full refund is available if the subscription is canceled within seven business days after automatic renewal.

  • Exceptions to the return policy: No refund requests will be accepted for users who have had their service suspended or terminated due to non-compliance with the terms.

Important Notes About Plans and Transition to Paid Service
  • Bildy will initially be a free app, but after 3 or 4 months, it will start offering paid plans. One free plan with limitations will still be available.

  • Users who register before the paid plans are implemented may lose access to certain services once these plans launch. They will be notified in advance about the changes and available options.
